Personal Information Collection Statement

(Relating to the Personal Data (Privacy) Ordinance (Cap.486) (“the Ordinance”)) ABC Computer Systems Limited (“the Company”)

1. Collection of Data

You may now, in the future, or may already have supplied the Company with personal data, including but not limited to your name, identity card number, contact details, address, financial information, and other identifying or transactional information. The Company may collect, retain, process, and update such data in the ordinary course of providing, maintaining, and administering internet services, facilities, and related business operations.

Failure to provide accurate and complete data may result in the Company being unable to establish, continue, or perform services, and the Company expressly disclaims any liability arising from such failure.

2. Purposes of Use

Your data may be used for one or more of the following purposes, and you expressly consent to such use:

  • Administration, operation, and management of services and facilities provided to you.

  • Conducting credit assessments, checks, and ongoing monitoring of creditworthiness.

  • Assisting third-party internet service providers or financial institutions in conducting credit checks.

  • Compliance with applicable laws, regulations, codes of practice, and lawful requests of authorities.

  • Determining, collecting, and enforcing payment obligations, subscription fees, and outstanding debts.

  • Direct marketing, promotion, and communication of products or services of the Company and/or its affiliates, subsidiaries, and business partners.

  • Liaising with the Telecommunications Authority under the Telecommunication Ordinance (Cap.106) and other governmental or regulatory bodies.

  • Any purposes directly or indirectly related to the above, including risk management, dispute resolution, and enforcement of contractual rights.

3. Disclosure of Data

The Company will treat your data as confidential but reserves the right to disclose such data to the following persons or entities, whether within or outside Hong Kong, to the maximum extent permitted by law:

  • Agents, contractors, and third-party service providers engaged in connection with the Company’s business operations.

  • Any person under a duty of confidentiality to the Company.

  • Actual or proposed assignees, transferees, participants, or sub-participants of the Company’s rights or obligations.

  • Government departments, regulatory authorities, law enforcement agencies, or other competent bodies of the Hong Kong Special Administrative Region or elsewhere.

  • Any other party where disclosure is reasonably necessary to protect the Company’s interests, enforce its rights, or comply with legal obligations.

The Company shall not be liable for any loss, damage, or claim arising from such disclosure, provided it is made in good faith and in accordance with applicable law.

4. Data Subject Rights

Under the Ordinance, you may:

  • Request confirmation of whether the Company holds data relating to you.

  • Request access to such data.

  • Request correction of any inaccurate data.

  • Request information regarding the Company’s data-handling practices.

All requests must be made in writing to the Data Protection Officer at the address below. The Company reserves the right to charge a reasonable fee for processing any data access or correction request. The Company further reserves the right to refuse requests that are frivolous, vexatious, or otherwise not made in good faith, to the fullest extent permitted by law.

5. Limitation of Liability

By providing data to the Company, you acknowledge and agree that:

  • The Company shall not be liable for any indirect, consequential, or incidental loss arising from the collection, use, disclosure, or retention of your data, except where liability cannot be excluded under applicable law.

  • The Company’s total liability in respect of any claim relating to personal data shall not exceed the amount of service fees paid by you to the Company in the preceding 12 months.

  • You indemnify and hold harmless the Company, its directors, officers, employees, and agents against any claims, damages, or liabilities arising from your provision of inaccurate, incomplete, or unlawful data.
