Privacy Policy

ABC Computer Systems Limited (“we,” “us,” “our,” or the “Company”) is committed to protecting the privacy of our customers and website visitors. This Privacy Policy explains how we collect, use, disclose, retain, and safeguard personal data in connection with our internet services, facilities, and related business operations (collectively, the “Services”).

We comply with the Personal Data (Privacy) Ordinance (Cap. 486, “PDPO”) of Hong Kong. Where applicable, we also comply with the European Union General Data Protection Regulation (“GDPR”) and other relevant laws (e.g., China’s Personal Information Protection Law).

This Policy does not apply to services offered by partners, resellers, or third parties. Please review their privacy policies separately.

1. Information We Collect

We collect personal data to provide and improve our Services. Categories include:

  • Personal identifiers: name, identity card number, date of birth, gender.

  • Contact details: email, phone, mailing address.

  • Financial information: billing details, credit card/bank account information.

We may also obtain information from third‑party sources (e.g., public records, credit agencies, partners) to verify identities, conduct credit checks, or enhance Services.

Our Services are intended for individuals 18 years or older. We do not knowingly collect data from minors.

2. Purposes of Use

We use personal data for legitimate business purposes, based on contractual necessity, legal obligations, legitimate interests, or consent. Uses include:

  • Service delivery: processing applications, managing accounts, provisioning Services, billing, identity verification, credit assessments, handling inquiries/complaints.

  • Improvements and support: technical assistance, market research, customer service enhancement.

  • Communications: renewal notices, newsletters, updates, security alerts, maintenance notifications.

  • Marketing: promoting our products, events, or those of affiliates/partners (with consent).

  • Compliance and risk management: meeting legal/regulatory requirements, liaising with authorities (e.g., Telecommunications Authority under Cap. 106), enforcing contracts, debt collection, fraud prevention.

  • Analytics: diagnosing issues, improving Services; anonymized after 12 months unless required longer.

  • Other related purposes: dispute resolution, risk assessment, enforcement of contractual rights.

Telephone calls may be recorded for quality and evidentiary purposes.

3. Disclosure of Data

We treat personal data as confidential but may disclose it when necessary, within or outside Hong Kong:

  • Service providers: agents, contractors, IT support, payment processors, debt collectors.

  • Affiliates and partners: subsidiaries, business partners in telecommunications/IT.

  • Financial institutions: banks, credit card issuers, credit agencies.

  • Legal/regulatory bodies: courts, law enforcement, government departments, regulators.

  • Business transfers: mergers, acquisitions, asset sales (with notice of controller changes).

  • Other parties: assignees of our rights, or where disclosure is necessary to protect our interests or comply with law.

We do not sell, rent, or trade personal data. Disclosures are limited to what is required and compliant with PDPO/GDPR. We are not liable for good‑faith disclosures made under law.

4. International Data Transfers

Data may be transferred outside Hong Kong for processing or storage. For jurisdictions without adequate protection, we use safeguards such as standard contractual clauses.

5. Data Retention

We retain personal data only as long as necessary for the stated purposes or as required by law (PDPO DPP3). After retention, data is securely deleted or anonymized.

Even after deletion requests, we may retain data for legitimate interests (e.g., dispute resolution, compliance).

6. Direct Marketing and Opt‑Outs

With your consent, we may use your name and contact details for direct marketing of our Services, events, or partner offerings.

All marketing emails include an unsubscribe link in the newsletter footer; to opt out, simply click that unsubscribe link.

7. Your Rights

Under PDPO and applicable laws (e.g., GDPR), you have rights to:

  • Confirm if we hold your data.

  • Access and obtain a copy.

  • Correct inaccuracies.

  • Request erasure (“right to be forgotten”).

  • Object to or restrict processing.

  • Data portability (structured format).

  • Withdraw consent (may affect Services).

  • No solely automated decisions with legal effects.

Requests must be made in writing to the Data Protection Officer. Identification may be required. We reserve the right to charge a reasonable service fee for processing data access, correction, or portability requests. We may refuse unfounded, frivolous, or vexatious requests.

8. Security Measures

We employ industry‑standard safeguards, including encryption (SSL), access controls, and staff training.

Credit card details are not stored; processed via secure third‑party gateways.

No system is infallible; we strive to mitigate risks but cannot guarantee absolute security.

9. Cookies and Tracking

We use cookies and similar technologies to:

  • Enhance security and session continuity,

  • Analyze usage,

  • Store preferences,

  • Personalize experiences.

You can disable cookies in your browser, though functionality may be affected.

10. Limitation of Liability

By providing data, you agree:

  • We are not liable for indirect, consequential, or incidental losses from data handling, except where non‑excludable by law.

  • Our total liability for data‑related claims is capped at fees paid in the prior 12 months.

  • You indemnify us against claims arising from inaccurate, incomplete, or unlawful data you provide.

  • We are not liable for any unauthorized access, hacking, data loss, corruption, or disclosure caused by events beyond our reasonable control, including cyberattacks, system failures, or force majeure incidents.

11. Changes to This Policy

This Policy may be updated at any time. Changes will be published on ABCHK’s website. Customers are responsible for monitoring updates and ensuring compliance
